الحمد لله، والصلاة والسلام على رسول الله، وعلى آله وصحبه، أما بعد:
فما ذكرته حول معاملات الشركة، وما اطلعنا عليه بعد البحث عنها في محركات البحث، لا يكفي للحكم على التعامل معها بإطلاق، لكن هنالك ضوابط شرعية إذا توفرت جاز التعامل، وإلا فلا. وهذه الضوابط هي:
1- أن يكون البيع والشراء بمقدار رأس المال. أي: إن الشركة لا تقرض المستثمر ليتعامل من خلالها، فيُجتنب ما يسمى بـ"الهامش" .
2- إذا كانت المتاجرة بالذهب أو الفضة، والعملات النقدية، فإنه يلزم مراعاة شروط ذلك كما هي مبينة في الفتوى رقم:179999 وهذا الضابط يعسر تحققه غالبا.
3- أن تكون الأنظمة الاستثمارية في أعيان مباحة.
4- اجتناب فوائد التبييت ونحوها مما فيه ربا، ولو مع عدم أخذه وتركه للشركة، بل يشترط خلو العقد منه أصلا، وإلا منع الدخول فيه.
إذا تحققت هذه الشروط جاز لك التعامل مع تلك الشركة، أو غيرها من الشركات . والمعروف من حال البورصة أنها تخل بأكثر هذه الشروط، ومجرد دعوى الالتزام بالضوابط الشرعية لا يكفي دون ممارسة ذلك واقعا؛ وانظر الفتوى رقم: 218419.
